Terms of Service

1. Acceptance of Terms

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

2. Description of Service

EdwiserCloud is a platform that provisions, hosts, and helps you operate WordPress and Moodle sites, with AI-assisted operations and monitoring, for agencies and their clients.

3. Accounts

You must provide accurate information, keep your credentials secure, and not share your account. You are responsible for all activity that occurs under your account and, where applicable, your agency.

4. Plans & Billing

Paid plans are billed monthly or yearly, and per site, through Stripe. Subscriptions renew automatically until cancelled. Cancelling stops future billing; charges already incurred are non-refundable except where required by law. You are responsible for any applicable taxes.

5. Acceptable Use

You agree not to use the Service to:

• Violate any law or the rights of others.
• Reverse engineer, disrupt, or interfere with the Service or its infrastructure.
• Access the Service through automated scraping or abuse.
• Host or distribute malicious, harmful, or unlawful content.

You are responsible for the content and end users of the sites you provision, and for ensuring they comply with applicable laws.

6. Your Sites & Content

You retain ownership of the sites and content you create. You authorize us to host, store, and operate them in order to provide the Service. While we provide backups as a convenience, you remain responsible for maintaining your own copies of critical data.

7. Third-Party Services & Trademarks

The Service relies on third-party infrastructure and services (such as Vultr, AWS, Google, and Stripe), each governed by its own terms. WordPress and Moodle are trademarks of their respective owners; EdwiserCloud is not affiliated with, endorsed by, or sponsored by them.

8. Intellectual Property

You own your content. The design, code, and branding of the Service belong to Edwiser and may not be copied or reused without permission.

9. Service Availability & Disclaimer

The Service is provided on an "as is" and "as available" basis. We aim for high availability but do not guarantee that the Service will be uninterrupted or error-free.

10. Limitation of Liability

To the maximum extent permitted by law, EdwiserCloud and Edwiser shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service.

11. Termination

We may suspend or terminate your access to the Service if you violate these Terms, or otherwise at our discretion. You may stop using the Service and close your account at any time.

12. Governing Law

These Terms are governed by the laws of India, and any disputes shall be subject to the courts located in India.

13. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
